Program Summary: Prosecutors know they have a distinct advantage when trying a black defendant to an all-white jury. As such, jury selection in many cases is wrought with the danger of racial manipulation. Also, peremptory challenges can make the threat of discrimination during jury selection even more real. This program will discuss how to conduct thoughtful and effective voir dire on race, and how to properly make a Batson Challenge and the law surrounding it.


You’ll learn how to ask non-threatening questions that allow the jurors to place themselves in the shoes of the defendant and alert the jury to the possibility that the prosecution might attempt to discriminate in your case. You’ll discover practical tips and techniques that you can apply directly to your next voir dire, including proxy question, scaled questions, de-selection techniques, implicit bias testing, validation and affirmation processes and more!


This program will also cover tools to fight unethical peremptory strikes and rebut false prosecutorial narratives used to justify these strikes. You will learn the basics and history of the Batson framework, how to use statistical evidence to disprove false prosecutorial misrepresentations, and how to track and present this empirical evidence persuasively to the court.
