State v. Stone - A Case Study on Child Sexual Molestation (2020)

CLE Credit: Up to 4 hours of self-study CLE credit, where authorized. Please confirm with your state's CLE commission to ensure this program is available for self-study CLE certification.

Program Summary: The defense of a child molestation case is unique from the defense of other criminal cases. The criminal defense attorney tasked with defending such a case has to be prepared to not only show reasonable doubt, but to answer this question: If it did not happen, how is it that the child believes it did happen? This groundbreaking program will take you on a 4-hour "deep dive" and live demo of the State v. Avis Stone trial, a multi-count, multiple victim, aggravated child molestation case recently tried in Georgia. The program will seek to answer the difficult questions raised in a child molestation case, and how to craft a theory of defense that is accepted and understood by jurors and the court.

The program begins with a general discussion of the facts and evidence of the case as well as potential themes & theories of the defense. Lectures and live demonstrations will then be given by three distinguished panels of seasoned attorneys and experts that will address the critical issues and evidence from the trial, including:

  • where to look for potential medical issues that advance the theory of the case
  • how to identify the right defense experts for specific issues in the case
  • how to prepare and present convincing expert testimony
  • how to identify contamination and suggestive questioning by the child forensic interviewer
  • how to use the forensic interview and expert testimony to neutralize the alleged victims' statements
  • how to highlight behavior of the alleged victim towards your client that is inconsistent with the allegations
  • how benign medical findings can mimic characteristics of sexual assault
  • how to effectively cross-examine the state's expert
