Program Summary: From the technical aspects of computer file-sharing programs, to the psychological factors that drive illegal online sexual behavior, this program is designed to help criminal defense practitioners understand the wide-range of challenges involving defending child pornography cases. You will learn how psychological, sexual, and technological factors combine to create a perfect storm that facilitates illegal online sexual behavior. The program emphasizes the mitigating factors applicable to sentencing hearings, and is based on psychological research regarding risk, recidivism, and amenability to treatment of the cybersex offender. You will also learn how to develop a “four-part (better) plan for success” when defending child pornography defendants, including knowing your evidence, demystifying the guidelines, deconstructing common assumptions, and principled alternative sentencing. In addition, you will discover how law enforcement agencies use malware and other hidden services to target your clients, and how to challenge the findings of those investigative techniques in court.
