Program Description: This program is designed to help criminal defense lawyers sharpen their motions practice in order to maximize their client’s position. You will learn about the use of Frey during the pre-trial phase of 21 U.S.C. § 841 & 846 prosecutions, as well as other pre-trial motions and strategy. Participants will also learn how to create motions directed at obtaining evidence for trial, while at the same time pushing for collateral successes (i.e. better pleas, dismissal of charges). The program will also address how important obtaining Brady is, and how to compel the prosecution to turn it over; Brady and Giglio violations will be explored and their importance discussed.
