Sex, Drugs, and 25 to Life: Toxicology in Sexual Assault Cases

Program Summary: This program will educate criminal defense practitioners on what Forensic Toxicology can offer in the litigation of alcohol and drug facilitated sexual assaults. Dr. Nikolas P. Lemos, a Board Certified Forensic Toxicologist, will discuss how to interpret the forensic lab report and how to use it along with your investigation and discovery to tell your client's story of innocence. Then Sandy Feinland, Forensic Lead Attorney for the San Francisco Public Defender, will cover the various legal strategies for using the forensic toxicology report in court, including attacking the forensic urinalysis test, Kelly-Frye issues, Mayberry defenses, interpreting circumstantial evidence and investigating the complaining witness' story of events.
