Program Summary: This program offers powerful tools for fortifying your defense strategies and identifying the legal challenges criminal defense lawyers face when challenging home and auto searches. You'll uncover the key issues in litigating these difficult cases, including: the definition of a home, common justifications for searching homes with and without warrants, investigative strategies to prepare for hearings and written motions, ideas for more creative oral arguments that bring the Court into the home, approaches for making arguments about the credibility (or lack there of) police officer observations and affidavits more persuasive to the court. You'll also learn how to bring motions for discovery and motions to dismiss on the grounds of selective enforcement on the basis of race.
You'll also discover where the fourth amendment begins in challenging auto searches. This program will lead you through the critical stages of a traffic stop and provide practical tips for successfully suppressing evidence that has been illegally seized. You'll also learn which questions to ask when considering the validity of a vehicle stop, how to construct motions that help suppress evidence and bar against warrantless searches, challenge any exigency, preserve issues, identify probable cause changes and challenge expert testimony.
