Al-Marri v. Spagone

United States Supreme Court; Case No. 08-368

Prior Decision

Opinion below Al-Marri v. Pucciarelli, 534 F.3d 213 (4th Cir. 2008)

Argument(s)

The government’s purported authority to indefinitely detain a lawful U.S. resident as an “enemy combatant” violates the Sixth Amendment and disrupts the criminal justice system and the courts. The Constitution requires full Sixth Amendment due process for all U.S. residents, especially in cases involving high security detainees and serious threats to national security.
