Committee Chair FAQ

There are two types of committees at NACDL, standing committees created by the Bylaws or act of the Board of Directors and ad hoc committees created by the President. Most committees at NACDL are ad hoc committees, and this guide will cover those.

How does a new committee get created?
The President has the power to create and discontinue committees. If you are interested in a new committee, first check the Committee Directory to see if one already exists that is related to the topic and contact the chair(s). NACDL has a robust portfolio of committees, and it is likely there is a committee related to the topic. If there is not a related committee contact the President.

How does someone get appointed to a committee?
Appointments are made by the President, including the selection of chairs. If someone is interested in joining a committee, they should contact the committee chair(s). The chair(s) will make the appointment request to the President.

What are the rules for voting and other committee actions?
The committee chair(s) have the authority to manage their committees in accordance with Robert’s Rules of Order for voting and other procedures. Committee procedures are generally less formal.

How does my committee resolve disagreement?
Committees are encouraged to settle disputes internally, and the chair(s) have authority over their committee. Disputes that cannot be resolved should be presented to the President. NACDL’s Code of Conduct for Affiliated Persons also applies to all committee meetings. Robust discussion is encouraged, and disagreement is expected, but abusive and harassing behavior is not tolerated.

Can I remove this person from my committee?
The President has power to appoint and remove individuals from a committee. The committee chair should make the request for removal to the President.

Can non-members join committees?
The NACDL Bylaws state that NACDL members are eligible to participate in the work of committees. When a non-member wants to join a committee, and they are eligible for membership, they should become a member before the request is made to the President. If they are not eligible for membership, and the individual brings unique value to a committee that is not available from members, exceptions can be made by the Executive Director.

Are staff assigned to committees?
There are select committees with staff liaisons to facilitate the work of the Association and provide advice to the volunteer leaders, but in general, staff are not assigned to committees. The work of a committee is done by the volunteer leadership. Volunteer leaders are encouraged to heed the advice of staff, especially in areas of policy.

Another group asked my committee to sign their letter, can I do that?
No, the power to sign letters and speak on behalf of NACDL is vested in the President under the Spokesperson policy in consultation with the Executive Director. The President can delegate someone else as the spokesperson on an issue as appropriate.

Can NACDL support this bill?
The decision to support or oppose legislation frequently involves considerations beyond the text and whether the measure aligns with NACDL policy.  Committees should consult with the Director of State Advocacy and Deputy Director regarding legislation.

A reporter called me; what do I do?
Under the Spokesperson policy, only the President (or someone specifically designated by the President) can speak on behalf of NACDL. If you are contacted by the media, you should not give a comment on behalf of NACDL or in your capacity as a NACDL committee member without the President’s express approval. You should direct the media to NACDL’s Senior Director of Public Affairs and Communications, Jonathan Hutson, who can coordinate with all parties. Jonathan's email is jhutson@nacdl.org.

Does my committee have a budget?
Committees are generally not assigned budgets, and they are not authorized to expend NACDL funds or enter into contracts. Committee proposals requiring association funds must be presented to the Executive Director.

Can my committee ask for donations?
The NACDL Foundation for Criminal Justice has a year-round fundraising strategy. It is important that there are no competing campaigns. Ideas for raising funds should be shared with the Chief Development Officer.

Can my committee host an event?
NACDL holds in-person and virtual events regularly and avoiding scheduling conflicts is critical. A committee interested in holding an event should consult with the Associate Executive Director for Legal Education and Professional Development. NACDL’s popular Exchange and Engage webinar series can be a valuable platform for highlighting and advancing committee initiatives.

I have a committee meeting at a seminar/Board Meeting, can I bring food?
No, the venue contracts for our meetings include strict rules regarding outside food. We are charged service and clean up fees for outside food. A committee interested in having food should consult with the Associate Executive Director for Legal Education and Professional Development.

Can I contact sponsors for my event?
All NACDL sponsorships are managed by the Chief Marketing Officer and Sales and Marketing Manager. Please contact them before soliciting any sponsorships yourself.

Can I add the NACDL logo to my thing?
The NACDL and NACDL Foundation for Criminal Justice branding is managed by the Chief Marketing Officer. The logos and branding elements are trademarked, and where and how they are used is important to protect those trademarks.
