Habitual Offender Sentencing Enhancements

NACDL is working with partners to end habitual offender sentencing enhancements in New Mexico.

In January 2021, HB 114 was introduced in the New Mexico House of Representatives. This bill would provide judges discretion as to whether and how much of a habitual offender sentencing enhancement to add to a basic felony sentence. It would also grant judges discretion to suspend or defer these sentencing enhancements. NACDL has supported HB 114.
