WHEREAS—
- to make clear that reports can be made directly by members, staff and others directly without having to go through a Board member or officer;
- to allow the President the option of designating more than three people to handle complaints if there are multiple complaints; and
- to ensure that the internal complaint process is free from conflicts of interests;
THEREFORE, BE IT RESOLVED that the first paragraph of the section entitled "Reporting Procedure" of NACDL's Code of Conduct shall be amended to read as follows:
“To ensure the Board knows of any such misconduct and can respond appropriately, reports of any possible violation of the Personal Conduct Policy must be made to a member of the Internal Complaint Committee (“Committee”) which shall consist of a panel of three members designated by the President, none of whom may be employees of NACDL. The President may, appoint a panel, or panels of three designees as needed to investigate any report or reports of a violation of the Personal Conduct Policy. The President shall not serve on any panel investigating any report of a violation of the Personal Conduct Policy.”
