Learn More About Second Look Sentencing
NACDL strongly supports efforts to adopt second look legislation to combat the detrimental consequences of lengthy sentences. In 2022, the New York State Legislature considered A.8894 / S.7872, legislation to allow individuals who have been sentenced to prison sentences of 10 years or longer to apply for a sentence reduction in the interests of justice.

The Case for Second Look Sentencing
While many individuals are behind bars for only a short time, the backbone of mass incarceration is people serving very lengthy sentences – often decades-long, and far longer than they would serve for comparable crimes elsewhere in the world. Society’s emerging recognition that it has over-used imprisonment is exemplified in a wide range of reforms aimed at reducing the potential for individuals to enter the criminal legal system. However, to tackle the problem of mass incarceration at its core, reforms must also target those currently experiencing incarceration. Second Look = Second Chance: The Case for Reconsidering Lengthy & Other Extreme Sentences
While many individuals are behind bars for only a short time, the backbone of mass incarceration is people serving very lengthy sentences – often decades-long, and far longer than they would serve for comparable crimes elsewhere in the world. Society’s emerging recognition that it has over-used imprisonment is exemplified in a wide range of changes at the front end: reducing the potential for individuals to enter the criminal justice system. However, to tackle the problem of mass incarceration at its core, reforms must also target those currently experiencing incarceration.
This webinar brings together practitioners and advocates for a discussion on “Second Look Sentencing,” an emerging legislative trend that seeks to provide individuals with the opportunity for resentencing or a sentence reduction after they have served a certain amount of time in prison. Panelists discuss “Second Look” legislative efforts to enact reforms nationwide, and NACDL’s model “Second Look Sentencing” legislation and accompanying report. On Thursday, April 14th, 2022, NACDL and The Sentencing Project hosted Legislating Freedom: The Importance of a Second Look. This panel discussion delved into the country’s continued overreliance on incarceration and extreme sentences and legislative efforts to enacted 'Second Look' laws which provide individuals with an opportunity for resentencing or a sentence reduction after they have served a certain amount of time in prison.The panel discussion was moderated by Alexandra Bailey, the End Life Imprisonment Strategist at The Sentencing Project, and featured Eric Alexander, Senior Advocate, Campaign for the Fair Sentencing of Youth; Warren Allen, End Life Imprisonment Fellow, The Sentencing Project; Lawanda Hollister; and Kate Mogulescu, Associate Professor of Clinical Law, Brooklyn Law School.
