Brief of Projecy for Privacy and Surveillance Accountability, Inc., as Amicus Curiae Supporting Defendant-Appellant and Petition for Rehearing En Banc

This brief argues that the geofence warrant's in Chatrie raise important question, and that the panel's opinion conflicts with the Fifth Circuit. It also argues that the seizure of geofence data is a search under the Fourth Amendment because of the Supreme Court's ruling in Carpenter and that even short-term location records are incompatible with Founding-Era privacy. Due to the lack of individualized probable cause, it also take the stance that geofence warrants are unconsitutional. As a result, it asks the Court to grant the defendant's en banc petition.
