In 2019 NACDL filed a statement with the Virginia Supreme Court in support of a Comment to Rule 3.8(d) which clarified a prosecutors ethical obligations to identify exculpatory information when they produce it within a larger body of materials. The Comment is opposed by the Department of Justice and is pending before the Virginia Supreme Court.
