Brief filed: 09/24/2019

Documents

Kelly v. United States

United States Supreme Court; Case No. 18-1059

Prior Decision

909 F.3d 550 (3rd Cir. Nov. 27, 2018)

Argument(s)

A state government's right to regulate traffic flow does not qualify as "money or property" under this Court's applications of the mail fraud statute. The deception charged in this case -- lying about the motivation for state governmental policy -- is not cognizable as fraud under the mail fraud statute.
