Argument(s)
The structure of the False Claims Act and the legislative history of the seal provision demonstrate an intent to preserve the government's interest in enforcement and the defendant's rights. In the current legal regime, seal violations automatically infringe defendant's rights. The seal provision must be strictly enforced because it is otherwise in relators' personal interest to violate the seal.
