Juror Compensation Explicitly Addressed State Law

Ala. Code § 12-19-210. Expenses.

(a) Regular jurors, grand and petit, shall be entitled to $10.00 expense allowance for each day’s services, $.05 for each mile traveled in going to and returning from court and ferriage and toll, to be proved by the oath of the juror before the clerk of the court. The clerk shall give each juror a certificate, stating therein the number of days he has served, the number of miles he has traveled, the amount of ferriage and toll he has paid and the amount of expense allowance to which he is entitled. The certificate shall be payable out of the State Treasury.

 

Ala. Code § 12-19-110. Generally.

Regular and tales jurors serving in the circuit court in civil cases are entitled to the same fees and allowances as provided by law for criminal cases, to be evidenced and paid in the same manner.

(a) Upon receiving a summons to report for jury duty, any employee, on the next day he or she is engaged in his or her employment, shall exhibit the summons to his or her immediate superior, and the employee shall thereupon be excused from his or her employment for the day or days required of him or her in serving as a juror in any court created by the constitutions of the United States or of the State of Alabama or the laws of the United States or of the State of Alabama.

(b) An employee may not be required or requested to use annual, vacation, unpaid leave, or sick leave for time spent responding to a summons for jury duty, time spent participating in the jury selection process, or for time spent actually serving on a jury. Nothing in this subsection shall be construed to require an employer to provide annual, vacation, or sick leave to employees who otherwise are not entitled to the benefits under policies of the employer.

(c) Notwithstanding the excused absence provided in subsection (a), any full-time employee shall be entitled to his or her usual compensation received from such employment.

(d) It shall be the duty of all persons paying jurors their fee or compensation for services to issue to each juror a statement showing the daily fee or compensation and the total fee or compensation received by the juror.

(e) Notwithstanding subsection (a), a court shall automatically postpone and reschedule the service of a summoned juror who is an employee of an employer with five or fewer full-time employees, or their equivalent, if another employee of that employer also has been summoned to appear during the same period. A postponement pursuant to this section shall not affect an individual’s right to one automatic postponement under Section 12-16-63.1.

Parking Provided Full

"Code of Ala. 45-45-82.02. Juror parking.

(a) The governing body of Madison County, by resolution thereof, shall have the power to maintain and provide parking for the use of the jurors; and shall have the power to appropriate such funds as are necessary and appropriate for such purpose. All resolutions providing parking for jurors shall be filed in the Probate Office of Madison County and with the Administrative Director of Courts.

(b) Upon the adoption of a resolution providing the parking described in this section, Madison County shall establish and maintain a separate fund known as the Madison County Juror Parking Fund. The county juror parking funds shall consist of funds appropriated by the state, county, or municipal governments, funds collected under provisions of law, or received from donations, gifts, grants, and funds other than those appropriated, and shall be audited as county funds are audited. The funds may be used to match grants for providing parking described in this section.

(c)

(1) For the support and maintenance of juror parking established under this section, a parking fee of five dollars ($5) shall be paid in all civil, domestic relations, criminal, juvenile, and child support cases in the district and circuit courts of Madison County to be collected and paid at the time as docket fees, fines, and other court costs. The parking fee described in this section shall be paid in all civil, domestic relations, criminal, juvenile, and child support cases in each court in the Twenty-third Judicial Circuit. All funds collected under this section shall be transmitted to the Madison County Juror Parking Fund by the tenth of each month following their collection.

(2) Except as provided herein, the Juror Parking Fund shall be used solely to contract with the City of Huntsville to provide juror parking within two blocks of the Madison County Courthouse. After a contract has been entered into with the City of Huntsville to provide parking for jurors, any residual funds in the Juror Parking Fund in excess of the funds needed on the date of the initial payment to commence the contract for juror parking plus any interest revenue which has accrued to the Juror Parking Fund on May 13, 2005, shall be transferred to the Circuit Clerk’s Fund as provided by Section 12–17–225.4, to be used for the purposes for which the Circuit Clerk’s Fund may be used under existing law and for the improvement of technology in the Twenty-third Judicial Circuit.

(3) The circuit clerk shall report to the Madison County Legislative Delegation by the fifth day of each regular session of the Legislature on the expenditure of funds transferred to the Circuit Clerk’s Fund pursuant to this section."
