Juror Compensation Explicitly Addressed State Law

Md Courts and Judicial Proc, § 8-426. Amount

(a) Basic. -- Subject to subsection (b) of this section, an individual is entitled, for each day that an individual is required to be in attendance at or proximity to a circuit court for a county for jury service, to:

(1) A State per diem of $ 15; and

(2) The supplement, if any, authorized by the county.

(b) Trial juror. -- A trial juror is entitled:

(1) For the first 5 days of jury service in one trial, to a State per diem of $ 15; and

(2) For each day of jury service in one trial in excess of 5 days, a State per diem of $ 50.

State Reimburses Counties Juror Compensation Fees

Md Courts & Judicial Proceedings § 8-427. Local levy and supplement

(a) Minimum supplement. --

(1) Subject to paragraph (2) of this subsection, the government of each county may set, by ordinance, an amount to supplement the State per diem and, for each fiscal year.

(2) Unless, by ordinance, a county government increases or decreases the supplement, the amount shall be enough to keep a total State per diem and county supplement equal to the county per diem as of June 30, 2001.

(b) County budget. -- The government of each county shall levy and appropriate for each fiscal year the amount needed to pay the State per diem, pending reimbursement by the Administrative Office of the Courts, and the county supplement, if any

Md Courts and Judicial Proceedings § 8-501. Employment loss

(a) Prohibited act. -- An employer may not deprive an individual of employment or coerce, intimidate, or threaten to discharge an individual because the individual:

(1) Loses employment time in responding to a summons under this title or attending, or being in proximity to, a circuit court for jury service under this title; or

(2) Exercises a right to refrain from work under subsection (b) of this section.

(b) Employer may not require employee to work at certain times on days of jury service. -- An employer may not require an individual who is summoned and appears for jury service for 4 or more hours, including traveling time, to work an employment shift that begins:

(1) On or after 5 p.m. on the day of the individual's appearance for jury service; or

(2) Before 3 a.m. on the day following the individual's appearance for jury service.

(c) Penalty. -- A person who violates any provision of this section is subject to a fine not exceeding $ 1,000.

Jurors Entitled to Both Juror Compensation

Juror Either Paid by Employer or by State

Md Labor and Employment Code § 9-402. Coverage required

(a) In general. -- Subject to subsections (b) through (f) of this section, each employer shall secure compensation for all covered employees of the employer by:

(1) maintaining insurance with an authorized insurer;

(2) participating in a governmental self-insurance group that meets the requirements of § 9-404 of this subtitle;

(3) participating in a self-insurance group of private employers that meets the requirements of Title 25, Subtitle 3 of the Insurance Article;

(4) maintaining self-insurance for an individual employer in accordance with § 9-405 of this subtitle; or

(5) having a county board of education or private noncollegiate institution secure compensation under § 8-402(c) or § 7-114(d) of the Education Article.

(b) Jurors. -- The State shall secure compensation for jurors by maintaining insurance with the Chesapeake Employers' Insurance Company and paying to the Company the premiums set by the Board for the Company as necessary to provide compensation for jurors.

(c) Organized militia. -- The Adjutant General shall secure compensation for officers and enlisted members of the organized militia of the State by maintaining insurance with the Chesapeake Employers' Insurance Company or an authorized insurer.

(d) Owner or trainer of racehorse. -- A licensed owner or trainer of a racehorse who is considered an employer under § 9-212 of this title is in compliance with the requirements of this subtitle if the owner or trainer is in compliance with the requirements of § 11-906 of the Business Regulation Article.

(e) Recipient of public assistance. -- The Secretary of Human Services shall secure compensation for a recipient of public assistance who is a covered employee under § 9-224 of this title by maintaining insurance with the Chesapeake Employers' Insurance Company and paying to the Company the premiums set by the Board for the Company as necessary to provide compensation for those individuals.

(f) Volunteer fire company or rescue squad -- Anne Arundel, Kent, and Prince George's counties. -- Anne Arundel, Kent, and Prince George's counties shall secure compensation for members of a volunteer fire company or volunteer rescue squad by maintaining insurance with the Chesapeake Employers' Insurance Company or an authorized insurer.
