Imagine a juror not only hearing the recording of a wiretapped phone but watching a recording of a video call for the same meeting. Does the government have the capability to intercept Zoom calls? How would video conferencing companies react to a subpoena or search warrant?

NACDL is writing to offer its qualified support for the Manager’s Substitute Amendment to the Email Privacy Act (H.R. 699). As amended, the Act updates the Electronic Communications Privacy Act (ECPA), the law that sets standards for government access to private internet communications, to reflect internet users’ reasonable expectations of privacy with respect to emails, texts, notes, photos, and other sensitive information stored in “the cloud.”

We, the undersigned companies and organizations, are writing to express our support for Chairman Leahy’s and Sen. Lee’s ECPA Amendments Act, S. 607, which the Committee will consider shortly. The bill would update the Electronic Communications Privacy Act (ECPA) to provide stronger protection to sensitive personal and proprietary communications stored in “the cloud.” We urge all Members of the Committee to support the bill.

We write to express our concerns about a proposal that would grant federal regulatory agencies authority to require web-based email service providers, cloud service providers and other Internet companies to disclose the contents of sensitive and proprietary communications or documents that they store on behalf of their customers.

We write today to urge you to support reform of the Electronic Communications Privacy Act (ECPA) to guarantee that every American has full constitutional and statutory protections for the emails, photos, text messages, and other documents that they send and share online.

NACDL expresses support on September 17, 2012 of Chairman Leahy’s amendment to H.R. 2471, which would update the Electronic Communications Privacy Act (ECPA) to provide protection to sensitive personal and proprietary communications stored in “the cloud.”

NACDL joined a letter on November 21, 2012 in support of Senator Leahy’s amendment to H.R. 2471, opposing any attempt to weaken this amendment and opposing a carve-out for civil investigations.
