In 2013, the North Dakota legislature enacted the Abortion Control Act, including a provision criminalizing abortion after detection of a fetal heartbeat. N.D. Cent. Code § 14-02.1-05.2. This provision bans abortions as early as six weeks and makes providing such a procedure a Class C felony. The only exceptions are “to prevent the death of a pregnant woman, to prevent a serious risk of the substantial and irreversible impairment of a major bodily function of the pregnant woman, or to save the life of an unborn child.” There are no exceptions for rape and incest.
